Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Release House website and services (the "Service"). "Release House" is a brand operated by Bohemian Office Music Marketing LLC, a company incorporated in Delaware, United States. In these Terms, "Release House," "we," "us," and "our" refer to Bohemian Office Music Marketing LLC operating as Release House, and "you" or "customer" refers to the person or entity using the Service.

By creating an account, submitting a release, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Release House provides managed music release and distribution services, which may include:

  • release preparation and review;
  • metadata management and review;
  • artwork and audio review;
  • handling of artist, contributor, and performer information;
  • ISRC and UPC assignment support where applicable;
  • editorial playlist pitching and submission support where included;
  • coordination and delivery through third-party distribution partners and digital music platforms;
  • release support.

Release House is a managed service, not a self-service upload tool. The specific services included depend on the package or services you purchase.

2. Eligibility and Authority

You must have the legal capacity and authority to enter into these Terms. If you use the Service on behalf of an artist, band, label, company, or another person, you represent and warrant that you are authorized to act on their behalf and to bind them to these Terms.

3. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate account information and to keep it up to date. Notify us promptly at support@releasehouse.com if you believe your account has been accessed without authorization.

4. Ownership of Your Music and Rights

You retain 100% ownership of your music and rights. Release House does not acquire ownership of your recordings, compositions, copyrights, artwork, or other intellectual property merely because you use the Service. Your music stays yours.

You grant Release House only the limited, non-exclusive, revocable permission necessary to process, review, format, reproduce, transmit, deliver, and otherwise handle the materials you submit, solely for the purpose of providing the services you have purchased (including delivery to distribution partners and digital platforms on your behalf). This permission exists only to operate the Service and does not transfer any ownership to us.

5. Your Content and Rights Responsibilities

You are solely responsible for ensuring that you hold all necessary rights, licenses, consents, and permissions for everything you submit, including but not limited to:

  • recordings and masters;
  • compositions and lyrics;
  • artwork and images;
  • samples, beats, and instrumentals;
  • featured performers and other contributors;
  • videos;
  • trademarks, names, and likenesses;
  • contributor and rights-holder information;
  • any other submitted content.

We may request evidence of your rights, and we may reject, hold, or suspend content where there is a reasonable rights, legal, fraud, distributor, or platform-policy concern.

6. Third-Party Platforms and Delivery

Distribution partners and digital music platforms are independent third parties with their own rules, requirements, and processes. Release House cannot guarantee platform acceptance, availability in every territory, exact processing times, or the exact display of metadata or artwork, as these depend on third parties.

Requested release dates are targets, not guarantees, where timing depends on third-party platforms or distributors, incomplete information, required revisions, or other circumstances outside our reasonable control.

7. Editorial Playlist Pitching

Where included, we may prepare and submit editorial playlist pitches on your behalf. Playlist placement is never guaranteed. Your payment is for the release and pitching services described, and is not payment for guaranteed playlist placement, streams, rankings, sales, exposure, chart performance, or editorial coverage.

8. Prohibited Activity

You must not use the Service in connection with artificial or fraudulent streaming, bots, click farms, stream or engagement manipulation, misrepresentation of rights, or any other activity that violates applicable law, distributor rules, or platform policies. Such activity may result in suspension or termination and may make an order non-refundable as described in the Refund & Cancellation Policy.

9. Payments

Prices are disclosed before purchase. Payments for Release House services are received by Bohemian Office Music Marketing LLC. We intend to process payments through Stripe as our payment processor as part of the checkout implementation; when enabled, your payment-card details are handled by Stripe, and Release House does not store your full payment-card details. Your use of the payment process may be subject to the payment processor's own terms.

Refunds and cancellations are governed by our Refund & Cancellation Policy, which forms part of these Terms.

10. Revisions and Cooperation

Providing the Service requires your cooperation, including submitting accurate and complete information and responding to revision requests in a timely manner. Delays or issues caused by inaccurate, incomplete, or missing information, or by a failure to provide requested revisions, are your responsibility.

11. Refusal and Suspension of Service

Subject to applicable law, we may refuse, hold, suspend, or terminate services for legitimate reasons, including suspected infringement, fraud, prohibited content, streaming manipulation, unpaid amounts or chargebacks, or a material violation of these Terms.

12. Release House Intellectual Property

The Release House name, brand, website, design, text, and software are the property of Bohemian Office Music Marketing LLC or its licensors and are protected by applicable intellectual property laws. These Terms do not grant you any right to use our brand or materials except as necessary to use the Service.

13. Service Availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service may be unavailable from time to time due to maintenance, updates, or factors outside our reasonable control.

14. No Guarantee of Results

We do not guarantee any particular commercial success, stream counts, audience growth, revenue, playlist placement, chart performance, or other third-party platform outcomes. Results depend on many factors outside our control.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Release House and Bohemian Office Music Marketing LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the Service. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, and this section is expressly subject to any non-waivable consumer rights you may have.

16. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Bohemian Office Music Marketing LLC (operating as Release House) and its officers, employees, and agents from claims, damages, and reasonable expenses arising out of your content, your breach of these Terms, or your violation of any law or third-party rights. This obligation is subject to applicable law and does not apply to the extent a claim results from our own acts.

17. Privacy

Our handling of personal information is described in our Privacy Policy. Please review it to understand how we collect and use information.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above. Material changes will take effect as permitted by applicable law, and your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

19. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except where mandatory consumer protection law in your country or region provides otherwise. Nothing in these Terms waives or restricts non-waivable consumer rights available to you under the laws of your jurisdiction.
